Verdicts & Settlements

At Kenny, O'Keefe & Usseglio, P.C., we take great pride in the results that we have obtained for our clients. Although past results do not guarantee future outcomes, here is a brief sampling of some of the verdicts and settlements that we have recently obtained on behalf of our clients:

$5 Million Medical Malpractice Settlement - Rick Kenny handled this case which involved a claim of birth trauma as a result of medical negligence at a local hospital.  With the assistance of our staff nurse and several outside medical experts, we were able to establish that the defendant hospital had deviated from the standard of care in the birth/delivery process.  We also engaged the services of an experienced life care planner to establish the costs associated with our infant client's future care needs.  We have also worked with an expert structured settlement company to establish a special needs trust for our young client in an effort to perserve his various public benefits. 

$3.76 Million Personal Injury Jury Verdict - Frank Usseglio and Tim O’Keefe successfully tried a case at Hartford Superior Court which resulted in a $3.76 million verdict for our client. Our client had been severely injured as a result of an explosion that occurred at his place of employment. To our knowledge, this verdict represents the single most significant and successful trial by an injured worker in avoidance of the traditional workers compensation bar against personal injury claims brought against employers. With pre-judgment interest, the judgment against the defendant was in excess of $5 million dollars. The case was settled for a confidential sum while on appeal by the defendant.

$3 Million Medical Malpractice Settlement - Richard Kenny and Tim O'Keefe settled this medical malpractice case just prior to the commencement of evidence at Hartford Superior Court.  The case involved the failure of an internist to properly diagnose rectal cancer.  We obtained expert opinions from several doctors who were prepared to testify that the internist breached the prevailing professional standard of care in the treatment of the patient.  We also retained the services of an experienced life care planner and an economist to provide analyses of our client's economic losses.  The case involved over two years of extensive pretrial preparation that included attendance at several depositions.  The case was successfully settled after an extensive mediation with Hartford Superior Court Judge John Langenbach.

$2.4 Million Personal Injury Jury Verdict - Richard Kenny was involved in obtaining a $2.4 million jury verdict at Bridgeport Superior Court for the 84 year old victim of a hit-and-run automobile accident. Our client suffered significant injuries to her left elbow as well as nerve damage to her right leg. The verdict included a rare punitive damages award of $266,914 and an award of pre-judgment interest which resulted in a judgment of approximately $3 million dollars.

$1.5 Million Medical Malpractice Settlement - Richard Kenny and Tim O'Keefe successfully settled this medical malpractice matter during jury selection at Hartford Superior Court.  The case involved the negligence of an emergency room physician in failing to properly diagnose our client's stroke.  As a result of the defendant's negligence, our client suffered significant injuries that will require lifelong medical care.  The case was settled with the assistance of the Honorable Jonathan Silbert. 

$1.2 Million Medical Malpractice Settlement - Tim O'Keefe handled this case that resulted in a successful resolution after an extensive mediation.  The case involved the failure of an emergency room physician to properly rule out our client's myocadial infarction prior to discharge from the emergency room.  Thankfully, our client survived.  With the assistance of two very experienced physicians, we were able to build a case that the emergency room physician in question deviated from an acceptable standard of care.

$1.2 Million Medical Malpractice Settlement - Richard Kenny announced the settlement of a medical malpractice claim against an emergency room physician and emergency room staff of a local hospital.  The case involved the defendants failing to properly diagnose a patient's heart attack.  As a result of the defendants' negligence, the patient died.  The firm retained the services of two expert physicians to assist in building a case against these defendants.  In addition, an expert economist assisted in preparing the claim for lost earnings.

$900,000 Medical Malpractice Settlement - Richard Kenny successfully settled a medical negligence case just prior to the commencement of trial at Hartford Superior Court.  The case involved a claim of substandard care delivery in a local emergency room which resulted in our client's partial loss of eyesight.  The case was resolved after a lengthy mediation.

$750,000.00 Clergy Abuse Settlement - Richard Kenny announced the settlement of a clergy abuse case for $750,000.00 against the Archdiocese of Norwich, Connecticut.  The claim involved abuse perpertrated by Father Bernard Bissonnette and dated back to 1962.  Our investigation in this case uncovered the fact that the Norwich Archdiocese continued to transfer Father Bissonnette from parish to parish despite continued concerns about his behavior involving young boys. The case was successfully settled after several years of investigation and included our successful appeal of a superior court decision that had dismissed the case on statute of limitations grounds.  Karen Clark successfully handled the appeal of the case before the Connecticut Supreme Court.   

$750,000 Premises Liability Settlement - This case was brought against a restaurant/bar for their failure to keep their premises in a reasonably safe condition. As a result of their negligence, our client suffered permanently disabling and life altering injuries. Richard Kenny obtained the settlement for our client after mediation before Hon. William O. Garfinkel at the United States District Courthouse in Bridgeport.

$625,000 Wrongful Death/Medical Malpractice Settlement - This case involved a claim against a community based health clinic for their failure to properly and timely diagnose our client’s brain aneurysm. Unfortunately, the health clinic’s negligence caused our client to suffer an untimely death. Richard Kenny successfully settled this case which was brought under the Federal Tort Claims Act.

$625,000 Wrongful Death/Medical Malpractice Settlement - Richard Kenny successfully settled this wrongful death claim against a hospital. The hospital had negligently failed to timely diagnose our client’s heart attack. Sadly, the hospital’s negligence caused our client’s untimely death.

$435,000.00 Medical Malpractice Settlement - Tim O’Keefe successfully settled a medical/pharmacy malpractice claim on the eve of trial in January 2005. Our client and his spouse suffered irreparable damage as a result of an error that was made by the defendant pharmacy in filling a prescription of an anti-psychotic medication. Our clients also pursued a claim against the defendant psychiatric hospital for their negligent failure to discover the error and their negligent failure to properly hospitalize our client once the error had been discovered. The case was settled after our firm successfully argued against the pharmacy’s pretrial motion to limit our expert’s testimony in the case.

$425,000.00 Personal Injury Settlement - Our client had suffered permanent disability to his lower back as a result of the negligence of the operator of a motor vehicle. This case was successfully settled by Tim O’Keefe after three days of jury trial at New Britain Superior Court.

$372,500 Medical Malpractice Settlement - Richard Kenny successfully obtained this settlement for our client against a naturopathic doctor. The naturopathic doctor negligently failed to properly and timely diagnose our client’s cancer. The settlement was obtained after an extensive mediation in Worcester, Massachusetts. Thankfully, our client is currently four years in remission and has a very optimistic prognosis.

$350,000.00 Personal Injury Settlement - Our client suffered an amputation injury to three and one-half fingers of his left hand. This claim involved a direct claim by an injured worker against his former employer. Tim O’Keefe successfully settled this case after an extensive mediation.

$350,000.00 Medical Malpractice Settlement - This case was successfully resolved by Richard Kenny during jury deliberations following a trial at Hartford Superior Court. The claim was brought against our client’s former ophthalmologist and was founded upon his negligence in puncturing our client’s eye during a cataract surgery. The defendant doctor and his insurance carrier refused to make any pretrial settlement offers in the case, but the case was successfully settled after the jury sent the trial judge a note during jury deliberations indicating that it wanted to know where to put our client’s medical expenses on the verdict form.

Confidential Wrongful Death Settlement -

A confidential wrongful death settlement was reached in a case involving a fifty-five year old man who was killed in a head-on automobile collision which occurred in East Hartford, Connecticut as a result of another driver's negligence.  Unfortunately, the negligent driver did not have adequate insurance to compensate the plaintiff's estate for its legal damages.  As a result, it was necessary to pursue the personal assets of the negligent driver.  This case was successfully handled by Rick Kenny.



Combination Medical Malpractice/Premises Liability Settlement - Richard Kenny and Tim O'Keefe successfully settled these cases which involved claims of medical negligence and defective premises.  A local property owner failed to keep an exterior staircase in a reasonably safe condition causing our client to violently fall to the ground and suffer extensive hand and leg injuries.  Unfortunately, the first treating physician failed to provide medical treatment that met the prevailing professional standard of care.  This caused further injury and expense to our client.  Both claims were filed in New Britain Superior Court and both were settled just prior to the commencement of trial.
