Defendant Hospital Sanctioned by Superior Court Judge for Withholding Documents in St. Francis Hospital Child Sex Abuse CaseOn August 1, 2011, Superior Court Judge Dan Shaban entered a sanctions order against St. Francis Hospital and Medical Center in the St. Francis Hospital Child Sex Abuse Case pending at Waterbury Superior Court. Judge Shaban ruled that the hospital should have turned over hundreds of pages of hospital documents prior to the commencement of trials. He also ruled that the hospital must pay legal fees and costs associated with the motion for sanctions and any further depositions that must be taken as a result of the hospital's discovery misconduct.
"We think this is a very important order in this case. Judge Shaban has made a very firm and direct order in direct response to the hospital's discovery violations. There is simply no place in civil litigation for this type of conduct." Timothy O'Keefe, Kenny, O'Keefe & Usseglio, P.C.
