Jury Awards Punitive Damages in Sexual Battery CaseOn Wednesday, May 26, 2010, a jury at Middletown Superior Court returned a plaintiff’s verdict in a sexual battery case against Anthony Nevico, Jr. The jury found that Mr. Nevico “acted with reckless indifference to the rights of others.” Based upon that jury finding, the judge in the case will make an assessment of punitive damages against the defendant.
“Our client is so thankful to the jury for their time and attention to this case. This has been a long and difficult ordeal for her. Finally, she got to present her case to a jury of her peers and they believed her. This will be tremendously helpful to her as she continues to seek closure in this matter.” Timothy L. O’Keefe, Esq., Kenny, O’Keefe & Usseglio, P.C.
“I told the jury during closing arguments that if they thought what the defendant did to our client was acceptable behavior in a civilized society then they should return a verdict against her. Obviously, they found Mr. Nevico’s behavior to be completely unacceptable.” Timothy L. O’Keefe, Esq., Kenny, O’Keefe & Usseglio, P.C.
